These Terms & Conditions govern the use of the Lankraz Hotel website (the “Website”) and reservations for accommodation and related services at Lankraz Hotel in Mauritius.
By accessing the Website, making a reservation or purchasing services through the Website, you acknowledge that you have read, understood and accepted these Terms & Conditions together with any specific conditions applicable to the rate, package, promotion or service you select.
Where specific booking or rate conditions differ from these general Terms & Conditions, the specific conditions communicated to you at the time of booking shall apply to that reservation.
1. USE OF THE WEBSITE
The Website is provided for information about Lankraz Hotel and its accommodation, facilities, services, offers and related activities, and to enable guests to make enquiries and reservations.
You agree to use the Website only for lawful purposes.
You must not:
- misuse or attempt to interfere with the Website or its systems;
- attempt to gain unauthorised access to any part of the Website;
- knowingly introduce viruses, malicious software or other harmful material;
- use automated systems to extract Website content without authorisation;
- make false, fraudulent or speculative reservations; or
- use the Website for any unlawful or unauthorised commercial purpose.
We reserve the right to restrict access to the Website or cancel transactions where fraudulent, abusive or inappropriate activity is reasonably suspected.
2. INTELLECTUAL PROPERTY
Unless otherwise indicated, the Website and its content, including text, photographs, graphics, logos, branding, videos, designs, icons and other materials, are owned by or licensed to Lankraz Hotel.
Such content may not be reproduced, distributed, modified, published, transmitted or commercially exploited without prior written authorisation from Lankraz Hotel or the relevant rights holder.
Third-party trademarks appearing on the Website remain the property of their respective owners.
3. RESERVATIONS
Reservations made through the Website are subject to availability and to the conditions applicable to the selected room, rate, package or offer.
Before confirming a reservation, you are responsible for reviewing:
- the hotel and room selected;
- dates of stay;
- number of guests;
- room occupancy;
- rate;
- taxes and applicable charges;
- included and excluded services;
- payment requirements; and
- cancellation and amendment conditions.
A reservation is considered confirmed once the booking process has been successfully completed and a booking confirmation has been issued.
You are responsible for ensuring that the information supplied during the reservation process is complete and accurate.
4. LEGITIMATE RESERVATIONS
Reservations must be made in good faith for accommodation to be used by you, your invited guests or persons on whose behalf you are authorised to make the reservation.
Reservations may not be made for unauthorised resale, speculative purposes, fraudulent purposes or with the intention of artificially restricting availability.
Lankraz Hotel reserves the right to cancel or refuse a reservation where there are reasonable grounds to suspect fraud, misuse, a manifest pricing or availability error, or other inappropriate activity.
If an obvious technical or pricing error has occurred, we will contact you as soon as reasonably possible to propose an appropriate solution.
5. RATES AND PRICING
Lankraz Hotel may use dynamic pricing. Room rates and offers may therefore change depending on factors including dates, availability, demand, occupancy and selected booking conditions.
The price applicable to your reservation is the price presented during the booking process and confirmed in your reservation confirmation, subject to any obvious error and any applicable changes in taxes or statutory charges.
Unless specifically stated otherwise, the room price does not include additional services such as meals, beverages, transportation, excursions, activities, spa treatments, laundry or other incidental expenses.
Any inclusions will be clearly indicated in the applicable rate or package description.
6. TAXES AND GOVERNMENT CHARGES
Applicable taxes, levies and statutory charges will be displayed during the booking process or communicated as required.
If a new government tax, levy or mandatory charge is introduced, or an existing charge is amended after a reservation has been made, Lankraz Hotel reserves the right to apply such charge where required by law.
Any mandatory tourist, accommodation or similar government levy applicable at the time of the stay may be payable separately unless expressly stated as included in the confirmed rate.
7. PAYMENT
Payment requirements depend on the rate, package or offer selected.
Depending on the booking conditions, payment may be:
- required in full at the time of reservation;
- required partially as a deposit;
- charged at a specified date before arrival; or
- payable at the Hotel.
The applicable payment conditions will be displayed during the booking process and/or included in your reservation confirmation.
Where a payment card is required to guarantee a reservation, you authorise the Hotel and/or its authorised payment service provider to process charges in accordance with the applicable reservation conditions.
Online payments may be processed by authorised third-party payment service providers using secure payment technologies.
Lankraz Hotel does not require guests to communicate full payment-card details by ordinary email.
8. CURRENCY AND EXCHANGE RATES
Prices may be displayed in one or more currencies for convenience.
Where currency conversion is offered, exchange rates may be determined by the booking system, payment provider, card issuer or financial institution processing the transaction.
Your bank or card provider may apply its own exchange rate or additional fees.
Lankraz Hotel is not responsible for exchange-rate differences or charges imposed independently by your financial institution.
9. CANCELLATIONS AND AMENDMENTS
Cancellation and amendment conditions vary according to the rate, offer or package selected.
Some rates may permit cancellation without charge until a specified deadline, while promotional, discounted or non-refundable rates may impose stricter conditions.
The cancellation conditions applicable to your reservation will be displayed before confirmation and/or included in your booking confirmation.
Where a cancellation fee applies, the amount will be determined according to those conditions.
Guests are responsible for reviewing the applicable cancellation policy before completing their reservation.
10. NO-SHOWS
A “no-show” occurs when a guest does not arrive for a confirmed reservation and has not cancelled the reservation within the permitted cancellation period.
In the event of a no-show, Lankraz Hotel may charge the amount specified in the applicable reservation conditions, which may include part or all of the reserved stay.
11. EARLY DEPARTURE
Where a guest chooses to depart before the confirmed departure date, charges may apply to the unused portion of the reservation depending on the conditions of the booked rate.
Any applicable early-departure charge will be determined in accordance with the reservation conditions and applicable law.
12. ARRIVAL AND DEPARTURE
Guests must comply with the Hotel’s applicable check-in and check-out times.
Early check-in and late check-out are subject to availability and may incur additional charges.
Guests may be required to present valid identification at check-in and, where appropriate, the payment card or other means of payment used to guarantee or pay for the reservation.
The Hotel may also request a payment card authorisation, deposit or other guarantee to cover incidental expenses during the stay.
13. CHILDREN AND OCCUPANCY
Room occupancy limits must be respected.
Guests are responsible for correctly declaring the number of adults and children included in the reservation.
Additional guests may be subject to supplementary charges and may only be accommodated where permitted by the room’s maximum occupancy.
Any child policies, age classifications, supplementary-bed arrangements or related charges applicable to a particular reservation will be communicated during the booking process or by the Hotel.
14. GUEST CONDUCT
Guests are expected to behave responsibly and respectfully toward other guests, Hotel employees, Hotel property and the surrounding community.
The Hotel may require a guest to leave the premises where the guest:
- behaves violently, abusively or threateningly;
- seriously disturbs other guests;
- deliberately damages Hotel property;
- engages in illegal activities;
- creates a significant health or safety risk; or
- repeatedly refuses to comply with reasonable Hotel rules.
Where removal results from serious misconduct, refunds may be refused to the extent permitted by applicable law.
Guests may be held responsible for damage caused intentionally or negligently by themselves or persons for whom they are responsible.
15. HOTEL WI-FI AND INTERNET ACCESS
Where Wi-Fi or internet access is provided, it is intended for lawful and reasonable use.
Guests must not use the Hotel’s internet connection for illegal activities, unauthorised access to systems, distribution of malicious software or infringement of intellectual-property rights.
Availability, speed and performance of internet services may vary and cannot be guaranteed at all times.
16. HOTEL FACILITIES AND SERVICES
Facilities, restaurants, activities and other Hotel services may be subject to opening hours, availability, weather conditions, maintenance, private events or operational requirements.
The Hotel may temporarily modify, restrict or close facilities where reasonably necessary for maintenance, health and safety, operational requirements or circumstances outside its reasonable control.
Where a material change affects a service specifically included as a significant component of your reservation, the Hotel will seek to provide an appropriate alternative where reasonably possible.
17. THIRD-PARTY SERVICES
Certain services offered or arranged in connection with your stay may be provided by independent third parties.
These may include transportation, excursions, activities or other external services.
Where a contract is entered into directly between the guest and an independent third-party provider, that service may be subject to the provider’s own terms and conditions.
Lankraz Hotel is not responsible for the acts or omissions of independent third-party providers except where liability cannot lawfully be excluded.
18. RELOCATION
In the exceptional event that Lankraz Hotel is unable to honour a confirmed accommodation reservation, we will use reasonable efforts to offer appropriate alternative accommodation of a comparable standard.
Where relocation results directly from circumstances within the Hotel’s responsibility, reasonable transportation associated with the relocation may be arranged or covered by the Hotel as appropriate.
Any relocation will be handled taking into account the circumstances of the reservation and applicable law.
19. FORCE MAJEURE
Lankraz Hotel shall not be liable for failure or delay in performing its obligations where such failure results from circumstances outside its reasonable control.
Such circumstances may include, without limitation:
- cyclones and severe weather;
- floods, fires and other natural disasters;
- epidemics or pandemics;
- war, terrorism or civil unrest;
- governmental actions or restrictions;
- strikes or industrial disputes;
- interruption of utilities or telecommunications;
- transportation disruption;
- unavoidable technical failures; or
- other events that make it impossible or unsafe to provide the reserved services.
Where such circumstances affect a reservation, the Hotel will seek a reasonable solution taking into account the circumstances and applicable law.
20. WEBSITE AVAILABILITY
We make reasonable efforts to ensure that information displayed on the Website is accurate and that the Website remains available.
However, we cannot guarantee that the Website will always be uninterrupted, error-free or free from technical problems.
The Website may occasionally be unavailable due to maintenance, upgrades, third-party system failures or circumstances outside our control.
21. LIMITATION OF LIABILITY
Nothing in these Terms & Conditions excludes or limits any liability that cannot legally be excluded or limited under applicable law.
Subject to this principle, Lankraz Hotel shall not be liable for indirect or consequential losses arising solely from the use or inability to use the Website.
Guests remain responsible for their personal belongings unless responsibility rests with the Hotel under applicable law.
Guests are encouraged to take reasonable precautions regarding valuables and to use any security facilities made available by the Hotel.
22. ELECTRONIC COMMUNICATIONS AND BOOKING RECORDS
By completing an online reservation, you acknowledge that electronic communications and records may be used in connection with your booking.
Reservation confirmations, payment records and other electronic records maintained through the Hotel’s authorised systems may constitute evidence of the transaction, subject to applicable law.
23. PRIVACY AND PERSONAL DATA
Personal information collected in connection with Website use, enquiries and reservations is processed in accordance with the Lankraz Hotel Privacy Policy and applicable data-protection legislation.
This may include information required to administer reservations, process payments, communicate with guests, comply with legal requirements and provide Hotel services.
